Driving under the influence is a specialized and highly technical area of the law. What used to be considered a glorified speeding ticket is now one of the most severely punished misdemeanors on the books. A person convicted of even a first time DUI is facing jail, fines, alcohol classes, mandatory installation of an interlock ignition device, license suspension, DMV points and high insurance costs. For these reasons, it is important for a person arrested for DUI to consult a qualified attorney as soon as possible.
When a driver is arrested for a DUI, the Department of Motor Vehicles will automatically start the process to suspend the driver’s license in 30 days. This will happen regardless of whether or not criminal charges are filed in court! A driver only has 10 days from the day they were arrested to request a hearing with the DMV to appeal the suspension. This hearing is called an “administrative per se” hearing and if one is not requested within 10 days, the right to a hearing is gone.
For most people – and for all commercial drivers – having your license suspended for any period of time can cause a huge impact on your life. And driving on a license that has been revoked or suspended is a criminal offense. Robbi Cook helps people get their licenses restored and represents individuals in hearings and appeals challenging their license suspensions.
Robbi Cook occasionally represents individuals contesting citations in Traffic Court and on Traffic Court appeals.
Often times a criminal record can be a stumbling block in the lives of those who are just trying to move on. A criminal record can impact job eligibility, insurance rates, citizenship, and the general quality of life. There are ways to clean up your “rap sheet” and get a clean slate. Among them: dismissing a misdemeanor conviction; reducing certain felonies to misdemeanors; and obtaining a certificate of rehabilitation and pardon. Contact The Law Office of Robbi Abrams Cook to start the process.
Robbi Cook represents clients seeking to modify/vacate restraining orders that are unjust or no longer serve their original purpose.
