DUI/Drunk Driving
Driving under the influence is a specialized and highly technical area of the law. What used to be considered a glorified speeding ticket is now one of the most severely punished misdemeanors on the books. DMV Proceeding
When a driver is arrested for a DUI, the Department of Motor Vehicles will automatically start the process to suspend the driver’s license in 30 days. This will happen regardless of whether or not criminal charges are filed in court! A driver only has 10 days from the day they were arrested to request a hearing with the DMV to appeal the suspension. This hearing is called an “administrative per se” hearing and if one is not requested within 10 days, the right to a hearing is gone.
